Participation Waiver

WAIVER & RELEASE: This is a Waiver and Release for participation in a Utah Division of State Parks and Recreation independent event/program operated by the Park City Sailing Association occurring in or about a Utah State Park. Injury may result from participation in this event/program. Additionally, property damage or loss may occur. You are expected to familiarize yourself with the rules of conduct for the event/program as well as Utah Division of State Parks and Recreation policies. You are expected to follow proper operating procedures including safety procedures, plus any directions given by an authorized park or event/program coordinator employee. The undersigned participant or parent, custodial parent or guardian of participant, being at least eighteen years of age, and in consideration of participation in a Park City Sailing Association event/program occurring in or about a Utah State Park (hereinafter “event/program”), does hereby agree to this waiver and release. I do hereby agree to assume all risks which may be associated with or may result from, participation in this event/program, including but not limited to the actual course of activities or while using the facility, parking lots, transportation or access to State Park’s facilities and recreation sites. I acknowledge that this particular event/program, while conducted on State Park land or facilities, is not under the supervision, regulation or control of Utah Division of State Parks and I cannot rely on the Utah Division of State Parks and Recreation to exercise any supervision, regulation or control of the event/program. I recognize that participation in the event/program may involve moderate to strenuous physical activity and may cause physical and or emotional distress to participants. There may also be associated health risks. I state that participant is free from any known heart, respiratory or other health problems that could prevent them from safely participating in any of the activities. I certify that participant has medical insurance or otherwise agree to be personally responsible for costs of any emergency or other medical care that participant receives. I agree to release the Park City Sailing Association, State of Utah, Utah Division of State Parks and Recreation and all their agencies, departments, officers, employees, agents and all sponsors, officials and staff or volunteers from the cost of any medical care that participant receives as a result of participation in the event/program. I further agree to release the Park City Sailing Association, the State of Utah, the Utah Division of State Parks and Recreation and all of their agencies, departments, officers, employees, agents and all sponsors, officials and staff or volunteers from any and all liability, claims, demands, breach of warranty, negligence, actions, and causes of actions whatsoever for any loss, claim, damage, injury, illness, attorney’s fees or harm of any kind or nature arising out of participation in the event/program. This release extends to any claim made by participant’s family, estate, heirs, or assigns arising from or in any way connected with the aforementioned activities. CONSENT FOR MEDICAL TREATMENT: I give permission to transport participant to the nearest source of emergency care, in order that necessary medical treatment not be delayed. Consent is expressly given, in the event of injury, for any emergency aid, anesthesia and/or operation, if in the opinion of the attending physician, such treatment is necessary. I have carefully read and understand the contents of the foregoing language and I specifically intend it to cover participation in the event/program. COVID-19 GUIDELINES & WAIVER: The undersigned individual who wishes to participate in sailing education and activities and/or utilize the boats, marine, and education facilities of the Park City Sailing Association (“PCSA”) in Jordanelle State Park hereby acknowledge that said organization is doing everything they can to protect the public as well myself as a user of the facility. To this extent; I agree to follow Center of Disease Control (“CDC”), State/County guidelines, and PCSA policies and procedures for social distancing and health and safety to reduce the spread of Novel Coronavirus, or COVID-19. This will require me to wear a mask when in ten (10) feet of other individuals outside my own household and to maintain as much distance when possible between myself, fellow sailors, instructors, volunteers, employees and patrons of the organization. This will require me to follow all of the guidelines set forth by PCSA. I agree to utilize surgical masks or improvised masks such as scarves, bandanas, buffs and handkerchiefs to reduce the risk of exposure to myself and others. I agree to wash my hands before participating in sailing and/or using PCSA equipment. I agree to participate in mandated sanitizing procedures after using equipment, and I agree to wash or sanitize my hands before and after boarding watercraft, as well as after using the restroom, sneezing, and coughing. I agree follow all guidelines and restrictions of the CDC, Utah Department of Health, and PCSA posted guidelines while on the water. Neither PCSA, State of Utah, nor the Utah Division of State Parks and Recreation, its agents, instructors, employees, volunteers or directors are responsible for any potential exposure to Novel Coronavirus, or COVID-19 at the PCSA Facility. By signing below, I agree to comply with the written instructions and statements above. Failure to comply with these written instructions or verbal instructions from staff may result in my privilege of using the marine facilities being revoked and I may be asked to leave the premises. PHOTO RELEASE: I hereby grant the Park City Sailing Association (PCSA) permission to use my likeness in photograph(s)/video in any and all of its publications and in any and all other media, whether now known or hereafter existing, controlled by the PCSA, in perpetuity, and for other use by the PCSA. I will make no monetary or other claim against the PCSA for the use of the photograph(s)/video. COMMUNICATIONS OPT-IN: I hereby grant the Park City Sailing Association (PCSA) permission to send me occasional emails and other communications.
